Federal-Aid Highway Construction Contractors Annual EEO Report (FHWA 1392)

All contractors working on federal-aid highway construction contracts of at least $10,000 between July 21, 2024 and July 27, 2024 are required to report their workforce by job category, gender, and ethnicity. MnDOT Office of Civil Rights (OCR) compiles data submitted by each contractor into one report and submits it to the Federal Highway Administration.

How to submit the required data

There is a separate reporting process for local (city and county) and MnDOT (highway) federal-aid highway construction contracts. Data is only required for construction contracts that include federal funds.

Local project (city and county)

A local federal project is a contract awarded by a city or county agency with an SP number. Contractors working on local federal construction projects should be aware of the following:

Data must be submitted or entered by Aug. 14, 2024, to ocrformsubmissions.dot@state.mn.us.

MnDOT project (highway)

A contractor must enter payroll in AASHTOWare Project, Civil Rights and Labor program and submit the FHWA 1391 by Aug. 14, 2024 to ocrformsubmissions.dot@state.mn.us.

The graph below represents the overall percentage of people working on federally funded highway projects in Minnesota during the last week of July each year who are women and/or people of color.

Federal Highway Administration 1392 Reports 2019 – 2023. There are two bars shown for each year, the first represents the percentage of women and the second the percentage of people of color working on federally funded highway projects in Minnesota during the last week of July for that year. In 2019, 11.1% of workers were women and 12.0% were people of color. In 2020, 11.3% of workers were women and 12.6% were people of color. In 2021, 11.4% of workers were women and 12.9% were people of color. In 2022, 11.4% of workers were women and 14.2 % were of color. In 2023, 12.9% of workers were women and 13.8% were people of color. Alternatively, the percentages of women were 11.1%, 11.3%, 11.1% and 12.9% in 2019 through 2023. The percentages of people of color were 12.0%, 12.6%, 14.2% and 13.8% in 2019 through 2023.
