How does the required right of way go from concept to right of way plat and acquisition? First, it takes the cooperation of four Metro Division areas:

  • Surveys
  • Pre-Design
  • Design
  • Right of Way

Next comes the compilation of a base map, construction limits and proposed right of way with detailed research produces information resulting in the computation of the plat boundary.

Lastly, the right of way package elements are produced and submitted for approval and acquisition:

  • Certificates of Title, Field Reports, Full & True Valuations - titles indicating current ownership, investigative reports confirming title ownership, easements, mortgages, liens, rental agreements, special assessments and tax information.
  • Well Reports - location and details of wells on the property.
  • Special Provisions - any arrangements or reservations made in regard to a parcel on a project.
  • Relocation Assistance and/or Housing Supplements - notification of relocation and other related financial assistance for particular parcels.
  • Utility Easements - easements on parcels to gas, electric or other utilities.
  • Work Map - pictorial representation of land lines, subdivision lines, property lines, inplace R/W, new R/W, permanent and temporary easements, access control, parcel ownership and affected areas. This map is used as a working version of the future Right of Way Map.
  • Authorization Map - similar to the work map, has proposed takings in red and previously acquired R/W in green. Used to get approval and appropriation for a project. Must include a Concurrence Memo if property is to be acquired by lot and block or metes and bounds descriptions.
  • Parcel Sketches - used to show total ownership of a parcel.
  • Building Books - used in the acquisition of a building. Shows a floor layout of the building--door, stair, and fireplace locations, a room type listing, yard structures, roof types, fixtures, septic systems and wells, concrete, and fences. Shows important dimensions and areas.
  • Minimum Damage Acquisition - MDA's are small parcels of permanent R/W or temporary easement that can be acquired without appraisal if valued under $5000.
  • Subdivision Plats - any subdivision plats, usually obtained from the county, contiguous to the project.
  • Plats Computations - mathematical representation of the plat boundary.
  • Tax Forms (W-9) - form sent to the IRS notifying them that a transaction has occurred.
  • Contaminated Properties - a listing of properties on the project that have been shown to have environmental contamination.
  • Non-Affected Titles - any titles ordered for a project that are unaffected by takings. This is an optional portion of the package.
