Policy statement

The Minnesota Department of Transportation (MnDOT) fully adopts the statewide policy, Americans with Disabilities Act – Title II, HR/LR #1358 which is issued by Minnesota Management and Budget (MMB) and incorporated herein by reference. MMB administers and maintains the statewide policy, assists agencies with implementing the provisions of the policy, and develops training for use by agencies.

MnDOT strives to be a model service provider, valuing inclusion and equity. The programs, services, products, and activities of MnDOT must be accessible to and usable by individuals with disabilities in accordance with Title II of the Americans with Disabilities Act (ADA). MnDOT must also take appropriate steps to ensure communications with applicants, participants, and members of the public with disabilities are as effective as communications with individuals without disabilities. MnDOT shall appoint an ADA Title II Coordinator to direct and coordinate MnDOT’s compliance with Title II of the ADA.

Reason for policy

MnDOT is committed to providing a welcoming environment to individuals with disabilities, ensuring equal access, full participation, and non-discrimination on the basis of disability.

The statewide policy, HR/LR #1358, requires agencies to:

  • Adopt the statewide policy.
  • Ensure qualified individuals with disabilities have an opportunity to request accessible communications, auxiliary aids, and services to participate in an agency’s programs, services, products, and activities.
  • Provide, as appropriate, employees with the training, supervision, and coaching necessary to ensure the employees can timely and appropriately respond to requests from individuals with disabilities in accordance with the law and statewide policy.
  • Appoint an ADA Coordinator to direct and coordinate the agency’s compliance with Title I and Title II of the ADA. (Note: MnDOT appoints two ADA Coordinators – one for Title I and one for Title II.)
  • Provide the name and contact information of the agency ADA Coordinator to employees upon request.
  • Complete and submit an annual report that documents compliance with the ADA.
  • Complete an ADA self-evaluation and develop a transition plan in accordance with the provisions within the statewide policy.
  • Provide notices and establish required policies and procedures.
  • Ensure compliance with laws, create relevant policies, and draft timely and accurate reports which are relevant to their specific programmatic responsibilities (e.g., Olmstead requirements).
  • Post the ADA grievance procedure in public areas with the contact information of the agency’s and/or state’s ADA coordinator.

Applicability

All MnDOT employees must comply with MnDOT policies.

Responsibilities

Commissioner

  • Appoint an ADA Coordinator to direct and coordinate the agency’s compliance with Title II of the ADA.

Assistant Division Director – Operations / ADA Title II Coordinator

  • Provide notices and establish required policies and procedures.
  • Ensure compliance with laws, create relevant policies, and draft timely and accurate reports which are relevant to MnDOT’s programs, services, products, activities, and specific programmatic responsibilities (e.g., Olmstead requirements).
  • Receive and resolve complaints alleging violations of Title II of the ADA.
  • Review the policy every two years, or whenever MMB makes changes to the statewide policy, to ensure the policy remains up-to-date.
  • Ensure training associated with the policy remains current.
  • Work with the Policy Coordinator to revise policy and/or confirm its accuracy.
  • Communicate policy revisions, reviews, and retirements to stakeholders.

ADA Policy Program Manager

  • Complete and submit an annual report that documents compliance with the ADA.
  • Complete an ADA self-evaluation and develop a transition plan in accordance with the provisions within the statewide policy.
  • Maintain MnDOT’s Title II complaint process and procedures and make recommendations to the Title II Coordinator, as needed, to update the process and procedures.
  • Track implementation progress of the ADA Transition Plan.
  • Provide, as appropriate, employees with the training, supervision, and coaching necessary to ensure the employees can timely and appropriately respond to requests from individuals with disabilities in accordance with the law and statewide policy.

Offices and Districts

  • Provide qualified individuals with disabilities an equal opportunity to participate, take part in, and benefit from MnDOT programs, services, products, and activities.
  • Ensure that communications and information created, published, or distributed by MnDOT is accessible or available in an accessible format upon request.
  • Inform potential participants of public, enterprise-wide, or agency-wide meetings about the availability of reasonable accommodations, modifications, and auxiliary aids.
  • Comply with state and federal legal requirements regarding the provisions of facilities that are accessible to and usable by individuals with disabilities.
  • Provide the name and contact information of the agency’s ADA Title II Coordinator to the public upon request.
  • Post the ADA Title II grievance procedure in public areas with the contact information of the agency’s Title II Coordinator and/or state’s ADA coordinator.
